Audio-Conference Description

The OIG now says that payments to vendors of referral software violate the federal anti-kickback statute. Hospitals’ discharge planners/case managers have used these types of software for many years to make referrals. Now what? Why do these payments violate the anti-kickback statute? Are there alternatives? If so, what are they? What should providers do about the contracts they currently have with vendors? Should they be terminated? Restructured? If so, how? What if hospitals insist on continuing to use the software and vendors require payments? What should providers do then? Register for this teleconference to get all the latest on this topic. Extensive handouts will be provided and there will be plenty of time for questions.

About the Speaker
Elizabeth Hogue is an attorney in private practice with extensive experience in health care. Prior to becoming an attorney, she was employed as a personnel manager by a Blue Cross-Blue Shield Plan. She studied at the University of Maryland School of Law, concentrating in health law, and gained considerable clinical experience, course work, and employment experience in this area. Following her admission to the Bar, she developed an active practice in health law. She represents clients all over the country. Her clients are professional associations, managed care providers, and institutional health care providers; including hospitals, long-term care facilities, home health agencies, durable medical equipment companies, and hospices. Ms. Hogue gives numerous presentations each year on health-related topics. Her articles are regularly included in trade association publications and other journals. She is a Fellow of the American Health Law Association.

Programs such as the Transforming Episode Accountability Model (TEAM) and the upcoming CJR-X model place greater financial responsibility on hospitals to successfully manage care transitions and patient outcomes for up to 90 days following discharge.

In this environment, selecting the right post-acute partners has become a strategic imperative.

High-performing home health agencies can play a critical role in helping hospitals reduce readmissions, improve patient outcomes, lower total cost of care, and successfully achieve quality and financial goals under bundled payment and value-based care programs. Speakers

Angela Huff, RN, Senior Manager, Forvis Mazars, Springfield, MO

With over 35 years of experience as a registered nurse, Angela has spent nearly 25 years in executive leadership in home health and hospice operations as well as software development in the post-acute space. In addition, she has global experience in the community care space that includes the United Kingdom, Finland, Canada, and Australia. Angela performs operations improvement assessments and compliance-focused reviews of home health and hospice documentation, including audits and appeals related to the OIG and program integrity contractors as well as compliance risk assessments related to mergers and acquisitions.

She is actively involved in the educational and advocacy activities the Alliance for Care at Home and is a member of the HHFMA’s Work Group Innovation, and Women in Leadership Committees. Angela has been a presenter at former NAHC and NHPCO conferences and the now Alliance conferences, as well as other industry national and state organizations and has been published in industry publications. She serves on industry advisory and state association boards across the industry. Before entering the post-acute industry, she served in acute care management positions and was a Certified Critical Care Registered Nurse and a Certified Registered Nurse Infusionist.

M. Aaron Little, Managing Director, Forvis Mazars, Springfield, MO

Aaron has more than 20 years of experience with the firm and oversees the operations of Forvis Mazars’ healthcare billing and revenue cycle services, a special team that manages the billing and revenue cycle operations for more than 100 home care, hospice, and senior living organizations throughout the nation. He routinely performs revenue and accounts receivable recovery services, billing operations efficiency and compliance assessments, client training, and other billing services. He frequently consults with providers and legal counsel on billing and operations compliance matters, including assisting providers with compliance audits required by the Office of Inspector General and program integrity contractors. Aaron also performs general financial and operational consulting services for home care and hospice organizations, including operations reviews, benchmarking, and cost report preparation.

Nationally recognized for his expertise in home care and hospice billing and operations, he serves on the Home Care & Hospice Financial Managers Association (HHFMA) Advisory Board and Workgroup. He was the initial chair of the HHFMA’s Young Professionals Committee and is currently chair of its Business Analytics Committee. He has previously served on the Visiting Nurse Associations of America (VNAA) Corporate Advisory Committee, an ad-hoc committee of the VNAA board of directors, and the Research Institute for Home Care’s Quality & Innovation Work Group. Aaron routinely presents educational seminars for the National Association for Home Care & Hospice (NAHC), HHFMA, National Hospice and Palliative Care Organization, and numerous other regional and state industry organizations. He is involved in supporting the Council of State Home Care Associations, as well as the advocacy efforts of numerous state home care and hospice associations. Aaron has been nationally recognized as an industry thought leader on Patient-Driven Groupings Model (PDGM). He participated in developing the data analytics and financial and operations content for NAHC’s 2019 PDGM National Summits and its 2020 PDGM Virtual Summits. Aaron has authored FORsights articles and is routinely quoted in national home care periodicals, including those published by Eli Research and DecisionHealth.

Aaron is a member of HHFMA, American Institute of CPAs, and Missouri Society of CPAs. He also is a member of Class 30 of Leadership Springfield and was selected by the Springfield Business Journal as a member of its 2015 class of “Forty Under 40,” which is awarded by an independent panel of judges to up-and-coming community professionals under age 40.

He is a 1997 summa cum laude graduate of College of the Ozarks, Point Lookout, Missouri, with a B.S. degree in business administration.

Meet the Speaker

Jennifer Osburn, RN, HCS-D, COS-C is a Clinical Consultant with Healthcare Provider Solutions (HPS). With over 30 years of home health experience, Jennifer brings a wealth of knowledge and expertise which includes education and training, agency management, quality, clinical case management, and software technology. She is also a credentialed OASIS and ICD-10 Coding expert.

Jennifer began her home health career in a large privately owned agency after transitioning from Medical-Surgical Urology hospital nursing; however, she has worked for all types of agencies in multiple states. Her love for sharing knowledge and experience led her to clinical consulting, where she enjoys translating technical guidance into information that the busy home health professional can deploy to improve the efficiency and quality of care being delivered to the patients they serve.

Jennifer Osburn has led numerous home health educational seminars for state and national associations as well as specifically designed education training plans for agencies for the past 12 years. In addition to consulting across the US, she has trained staff for The Joint Commission and ACHC, has authored numerous industry blogs and articles, and has assisted home health software companies with solutions that ensure compliance with Medicare guidelines. Her areas of expertise and firsthand experience include OASIS, ICD-10-CM Coding, Case Management, Medicare Home Health Conditions of Participation, Billing Requirements, Documentation Compliance for Quality and Payment, Emergency Preparedness, Agency Operations, and PDGM.

She routinely conducts home care and hospice reimbursement workshops and speaks at state association meetings throughout the country. Melinda has extensive experience in Medicare Patient-Driven Groupings Model (PDGM) training, billing, collections, case-mix calculations, chart reviews, and due diligence. Medicare appeals (UPIC, RA, ADR, and TPE) with all the Medicare Administrative Contractors (MACs) have become the forefront of Melinda’s current impact on the industry. She is currently serving as the Chair of the National Association for Home Care & Hospice (NAHC) Home Care and Hospice Financial Managers Association (HHFMA) Advisory Board and Work Group, Treasurer of the Home Care Association of Florida Board of Directors and serves on the Tennessee Association for Home Care Board.
