    Adding Value to Value Based Purchasing

    Webinar Overview:  Value Based Purchasing is now a CMS program being piloted in nine states. Success in this payment model requires preparation so all states are advised to consider necessary strategies now. This webinar will give a brief overview of the payment model; describe the data sources and measures used in the model; and data needed to determine how episodic payments are affected by the CMS metrics.  Lastly, strategies for improving outcomes on the CMS metrics will be discussed.

    Objectives:  After attending this webinar, the participant will be able to:

    • Identify key components of the new CMS bundled payment models
    • Describe the type of data that CMS will use in determining payment in value based purchasing
    • Identify how agencies can determine the impact to episodic payments
    • Describe ways to improve outcome performance on the VBP measures

    Therapy in Home Health
    Issues update; How to use and document maintenance therapy

    Webinar Overview:  Therapy services change in home health corresponding to policy and payment changes. Current payment reform indicates potential new opportunities for therapy involvement, as well as concerns for therapy reduction from MedPAC’s recommendations. What has not changed, however, is longstanding coverage for maintenance therapy, even though agencies have varying approaches to this covered service. This webinar will review unfolding issues that will impact therapy in home health as well as review how to appropriately use and document maintenance services.

    Objectives:  After attending this webinar, the participant will be able to:

    • Describe impending issues in home health that will impact therapy practice
    • Explain coverage of maintenance therapy and identify source reference
    • Describe common misconceptions and misuse of maintenance therapy and proper use of this coverage
    • Define proper documentation of maintenance therapy

    Preparation for Proposed Conditions of Participation
    Thursday, April 7, 2016 * 1:00 – 2:30 p.m. CST

    Webinar Overview:  There have been many changes issued from CMS regarding payment changes and new payment models that focus on outcomes as a part of the model. The proposed CoPs CMS issued in late 2014 are mirroring some of those expectations, “focusing on the care provided to patients and the impact of that care on patient outcomes”.  Agencies are called upon to “build a foundation for ongoing, data-driven, agency-wide quality improvement”.  This webinar outlines those proposed changes to the CoPs and challenges agencies to consider those operational changes necessary to meet the new conditions.

    Objectives:  After attending this webinar, the participant will be able to:

    • Identify changes in the proposed CoPs
    • Describe those changes with the greatest impact on agency operations
    • Define potential changes in own agency regarding auditing practices
    • Define potential changes in own agency regarding care coordination and collaboration

    Karen is an occupational therapist with 30 years of home care experience as a provider and clinical manager. She specializes in clinical and general operations consulting services to home care and hospice agencies and helps providers establish and maintain quality management practices. Specifically, she provides care management training and implementation, OASIS accuracy and compliance assessments, operations and productivity assessments and other similar services.

    Registration Fee: 
    KHCA Members:  $149 per webinar or $399 for series;  Non-Members:  $298 per webinar or $798 for series.   Registration fees are based on one phone/webinar connection per webinar offering; multiple site participation for your agency will require a separate registration fee for each connection.  Sharing of registration or fees with other agencies and/or individuals is prohibited.

    Recording:  If you are unable to participate in one or more of the live webinars of this series, recordings will be made available online through Thursday, April 21, 2016.

    Registration Deadline:  Those registering for the live presentation must do so at least three days prior.  Registrations to access the recordings (see above) will be accepted through April 7.

    Confirmation:  Approximately three days prior to each live webinar, a confirmation will be emailed to you.  This confirmation will include a link to access the presentation handouts, the sign-in sheet, and evaluation, as well as a link enabling you to access the webinar.

    CEUs:  Kansas Home Care Association is approved as a provider of CNE by the Kansas State Board of Nursing. Each course offering is approved independently for 1.8 contact hours applicable for APRN, RN, or LPN relicensure. Kansas State Board of Nursing provider number: LT0287-314.  APRNs, RNs and LPNs must participate in the entire presentation in order for contact hours to be awarded – partial credit will not be available.  To apply for nursing contact hours, within one week following webinar participation, a completed sign-in sheet and evaluations from each individual must be returned to KHCA.  Certificates will then be issued by e-mail. 

    Cancellations:   Fees will be refunded only if written cancellation is received one week prior to the workshop and no refunds after the dial-in number is sent to your agency. In the event of a written cancellation, KHCA will retain, or charge, $25 of the initial registration fee, per registrant, to cover administrative overhead.

    Per Visit Pay of RNs and Therapists Has Become Dangerous!


    Webinar – Wednesday, March 16, 2016

    Many agencies simply assume that registered nurses and therapists who are paid on a per visit basis are exempt from minimum wage and overtime pay under the federal Fair Labor Standards Act (FLSA).  Unfortunately, that is not the case.  In recent years, agencies have rarely been successful in convincing courts that professional employees paid on a per visit basis are exempt. As a result, the agency is subject to significant penalties including back pay awards for up to 3 years, twice that amount in damages and the employees’ attorney fees.

    This webinar will first identify the things which must be proved before an RN or therapist falls into the FLSA’s professional exemption from minimum wage and overtime pay.  It will then review the court cases which have addressed whether per visit pay under various circumstances meets the requirements for the professional exemption.  It will conclude by identifying the options available to agencies in light of the current legal risks as well as the primary compliance issue when nonexempt employees are paid on a per visit basis.


    This Webinar Will Cover:

    • What must your agency be able to prove before an RN or therapist who is paid on a per visit basis is exempt from minimum wage and overtime pay?
    • What is meant by “fee basis of payment?”  How is fee basis of payment important to the per visit pay issue?
    • Why paying per visit plus additional pay for other work, such as inservices, can cause loss of the exemption?
    • Why using a point system to establish the amount of the per visit pay usually does not solve the problem?
    • What compensation method avoids the legal risks surrounding per visit pay?
    • How do you determine if a per visit employee is a part time employee for purposes of the employer mandate.
    • How is overtime pay calculated for a nonexempt employee who is paid on a per visit basis?

    Presenters: 

    John C. Gilliland, II, is an Employment and Health Law attorney practicing from the office of Gilliland, Maguire & Harper, P.C., Indianapolis, Indiana. Mr. Gilliland received his JD from the Georgetown University Law Center, Washington, DC and was a Rotary Foundation Fellow, Faculty of Law, Queens University of Belfast, Northern Ireland. He practices in the areas of health law, employment law, wage and hour law, and HIPAA. Mr. Gilliland is a frequent speaker for state, local and national health care organizations and publishers concerning his practice areas.

    Eileen Maguire is an Employment and Wage and Hour Law attorney practicing from the office of Gilliland, Maguire & Harper, P.C.  While based in Indianapolis, Ms. Maguire serves home care, home health and hospice agencies nationwide, assisting with their employment law, and wage and hour compliance needs.  Ms. Maguire is a frequent speaker, trainer and author for her practice areas. She received her J.D. from Indiana University, Maurer School of Law, Bloomington, IN.
